These Terms of Use (“Terms”) govern your access to and use of the Nerve website and waitlist (the “Site”), operated by Nerve Hospitality Pty Ltd (Nerve, “we”, “us” or “our”). By accessing or using the Site, you agree to these Terms. If you do not agree, please do not use the Site.

1. About Nerve and the waitlist

Nerve is a hotel operations platform that is currently in development. The Site presents information about Nerve and lets you register interest by joining our waitlist. Joining the waitlist does not create any obligation on us to provide the product or any particular feature, and does not guarantee access. Information on the Site describes our current plans and may change as the product evolves.

2. Eligibility

The Site is intended for business and professional users aged 18 or over. By using the Site you confirm that you meet these requirements and that any information you provide is accurate and your own (or that you are authorised to provide it).

3. Acceptable use

You agree not to:

• use the Site for any unlawful, harmful or fraudulent purpose;
• attempt to gain unauthorised access to, interfere with, or disrupt the Site or its underlying systems;
• scrape, copy, or harvest content or data from the Site except as permitted by law;
• submit false information, or another person’s information without their consent; or
• misuse the Site in any way that could damage, disable or impair it.

4. Intellectual property

The Site and its content — including text, graphics, logos, the Nerve name and mark, design and code — are owned by Nerve Hospitality Pty Ltd or our licensors and are protected by intellectual property laws. We grant you a limited, non-exclusive, non-transferable right to access and view the Site for your own informational use. You may not reproduce, distribute or create derivative works from the Site without our prior written permission.

OPERA Cloud is a trademark of Oracle Corporation. Nerve is an independent product and is not affiliated with, endorsed by, or sponsored by Oracle. Other trademarks referenced on the Site belong to their respective owners.

5. Communications

If you join the waitlist or contact us, you agree that we may contact you about Nerve, including product updates and early-access information. You can opt out of marketing communications at any time using the unsubscribe link in our emails or by contacting us. Our handling of your personal information is described in our Privacy Policy.

6. Third-party services and links

The Site may use third-party services (such as analytics and form providers) and may link to third-party websites. We are not responsible for the content, products or practices of third parties, and your use of them is subject to their own terms.

7. Disclaimers

The Site and its content are provided “as is” and “as available”. To the maximum extent permitted by law, we make no warranties or representations about the accuracy, completeness or availability of the Site, and we disclaim all implied warranties. Any forward-looking statements about Nerve reflect current intentions only and are not commitments.

8. Limitation of liability

Nothing in these Terms excludes, restricts or modifies any consumer guarantee, right or remedy under the Australian Consumer Law or any other law that cannot lawfully be excluded. Subject to that, to the maximum extent permitted by law, we will not be liable for any indirect, incidental, special or consequential loss, or loss of profits, revenue or data, arising out of or in connection with your use of the Site.

9. Changes to the Site and these Terms

We may change, suspend or discontinue any part of the Site at any time, and we may update these Terms from time to time. The current version will always be posted on this page with the “Last updated” date. Your continued use of the Site after changes take effect means you accept the updated Terms.

10. Governing law

These Terms are governed by the laws of Victoria, Australia, and you submit to the non-exclusive jurisdiction of the courts of that state and the Commonwealth of Australia.
